Terms of Service

Welcome to Birthday Hunter. These Terms of Service ("Terms") constitute a legally binding agreement between you ("you," "your," or "User") and Birthday Hunter ("we," "us," "our," or the "Company") governing your access to and use of our mobile application, website, and services (collectively, the "Service").

1. Acceptance of Terms

By creating an account, accessing, or using the Birthday Hunter Service in any way, you acknowledge that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, and any additional terms and policies referenced herein. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on our Service and updating the "Last updated" date. Your continued use of the Service following any changes constitutes acceptance of those changes. It is your responsibility to review these Terms periodically.

2. Description of Service

2.1 What We Provide

Birthday Hunter is an information platform that aggregates and displays birthday deals, offers, freebies, and promotions from various third-party businesses ("Partner Offers"). The Service allows users to discover potential birthday rewards and deals offered by restaurants, retailers, and other businesses.

2.2 Information Service Only

BIRTHDAY HUNTER IS SOLELY AN INFORMATION AGGREGATION SERVICE. WE DO NOT CREATE, CONTROL, VERIFY, GUARANTEE, OR ENDORSE ANY OFFERS, DEALS, PROMOTIONS, OR REWARDS DISPLAYED ON OUR PLATFORM.

We compile information about birthday offers from publicly available sources, direct submissions, and third-party data providers. We make reasonable efforts to maintain accurate information, but we cannot and do not guarantee the accuracy, completeness, timeliness, or availability of any offer.

2.3 No Guarantee of Offers

We expressly disclaim any responsibility or liability for:

• The availability, validity, or terms of any offer displayed on our Service
• Any changes, modifications, or discontinuation of offers by third-party businesses
• The refusal of any business to honor an offer for any reason
• Any discrepancies between information displayed and actual offer terms
• Any losses, disappointments, or inconveniences resulting from reliance on offer information

3. Subscription and Payment Terms

3.1 Free and Premium Services

Birthday Hunter offers both free and premium subscription tiers. The free version of our app is available to download at no cost and provides limited access to our features. Premium subscriptions ("Birthday Hunter Pro") unlock additional features, including unlimited deal access, advanced filters, premium notifications, and ad-free experience.

3.2 Subscription Pricing

Premium subscriptions are available on a monthly or annual basis. Current pricing is displayed in the app and may vary by region. Prices are subject to change; however, price changes will not affect active subscription periods.

3.3 Automatic Renewal

ALL PREMIUM SUBSCRIPTIONS AUTOMATICALLY RENEW UNLESS YOU CANCEL BEFORE THE RENEWAL DATE.

• Monthly subscriptions renew every month on the same date as your initial purchase
• Annual subscriptions renew every 12 months on the anniversary of your initial purchase
• Your payment method will be automatically charged at the then-current subscription rate
• You will receive a reminder before renewal if required by applicable law

3.4 Cancellation

You may cancel your subscription at any time through your app store account settings (Apple App Store or Google Play Store) or through our app settings. Cancellation will take effect at the end of your current billing period. You will continue to have access to premium features until your subscription expires.

3.5 Refund Policy

All subscription payments are non-refundable. We do not provide refunds or credits for any partial subscription periods, unused features, or dissatisfaction with the Service. Refund requests for app store purchases must be directed to Apple or Google, as applicable, in accordance with their respective refund policies.

3.6 Free Trial

We may offer free trials of premium features from time to time. Unless you cancel before the trial ends, your payment method will be charged the applicable subscription fee. Free trial availability and terms may vary and are subject to change.

4. User Accounts

4.1 Account Registration

To access certain features, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Maintain the confidentiality of your login credentials
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized use of your account

4.2 Account Requirements

You must be at least 13 years old (or 16 in the European Economic Area) to create an account. By creating an account, you represent that you meet this age requirement.

4.3 Account Termination

We reserve the right to suspend or terminate your account at any time, with or without cause, with or without notice. Grounds for termination include, but are not limited to, violation of these Terms, fraudulent activity, abusive behavior, or extended periods of inactivity.

5. User Conduct and Prohibited Activities

You agree not to:

• Use the Service for any illegal, harmful, or unauthorized purpose
• Violate any applicable laws, regulations, or third-party rights
• Provide false, misleading, or fraudulent information (including false birthdays)
• Attempt to gain unauthorized access to our systems or other user accounts
• Interfere with or disrupt the Service or servers
• Use automated tools, bots, or scripts to access the Service
• Scrape, harvest, or collect information from our Service
• Circumvent or manipulate our systems or security measures
• Reverse engineer, decompile, or disassemble any part of the Service
• Use the Service to send spam or unsolicited communications
• Impersonate any person or entity
• Resell, redistribute, or commercially exploit our Service or content
• Abuse offers by using false information, multiple accounts, or other fraudulent means

6. Third-Party Offers and Businesses

6.1 No Affiliation

Birthday Hunter is not affiliated with, endorsed by, or partnered with any of the businesses whose offers are displayed on our Service, unless explicitly stated otherwise. The display of any business name, logo, or offer does not imply any relationship, sponsorship, or endorsement.

6.2 Third-Party Terms

Each offer is subject to the terms and conditions set by the offering business. We have no control over and are not responsible for the terms, availability, or fulfillment of any third-party offer. You are solely responsible for reviewing and complying with any third-party terms.

6.3 Redemption at Your Own Risk

ANY ATTEMPT TO REDEEM OFFERS IS DONE AT YOUR OWN RISK. WE ARE NOT RESPONSIBLE FOR ANY ISSUES ARISING FROM YOUR INTERACTIONS WITH THIRD-PARTY BUSINESSES, INCLUDING BUT NOT LIMITED TO:

• Refusal to honor advertised offers
• Requirements not disclosed on our platform (purchases, membership, verification)
• Changes to offer terms or expiration dates
• Quality of products or services received
• Personal injury or property damage
• Disputes regarding offer validity or terms
• Food allergies, dietary restrictions, or health concerns

7. Intellectual Property

7.1 Our Intellectual Property

The Service and its original content, features, and functionality are owned by Birthday Hunter and are protected by copyright, trademark, and other intellectual property laws. This includes our logo, design, text, graphics, software, and compilation of content.

7.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use our Service for your personal, non-commercial use. This license does not include the right to:

• Modify, copy, or create derivative works from our Service
• Use any data mining, robots, or similar data gathering methods
• Download, copy, or distribute any content (except for personal use)
• Use our trademarks or branding without written permission

7.3 User Content

By submitting any content to our Service (deal suggestions, reviews, feedback), you grant us a worldwide, royalty-free, perpetual, irrevocable license to use, reproduce, modify, publish, and distribute such content for any purpose. You represent that you have all necessary rights to grant this license.

8. Disclaimer of Warranties

We do not warrant that:

• The Service will be uninterrupted, secure, or error-free
• The information or content on the Service is accurate, reliable, or complete
• Any offers displayed will be available, valid, or honored by third parties
• The Service will meet your requirements or expectations
• Any errors or defects will be corrected
• The Service is free of viruses or other harmful components

Some jurisdictions do not allow the exclusion of implied warranties, so some of the above exclusions may not apply to you. In such jurisdictions, our liability is limited to the maximum extent permitted by law.

9. Limitation of Liability

This limitation applies to damages arising from:

• Your use or inability to use the Service
• Any content or information obtained through the Service
• Unauthorized access to or alteration of your data
• Third-party conduct or content on the Service
• Any offers, deals, or promotions displayed on the Service
• Actions or omissions of third-party businesses
• Any matter related to the Service

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100 USD).

Some jurisdictions do not allow the limitation of liability for certain damages, so some of the above limitations may not apply to you.

10. Indemnification

You agree to indemnify, defend, and hold harmless Birthday Hunter, its officers, directors, employees, agents, affiliates, and licensors from and against any and all claims, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from or related to:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights, including intellectual property rights
• Your violation of any applicable laws or regulations
• Any content you submit to the Service
• Your interactions with third-party businesses
• Any fraudulent or deceptive conduct on your part

11. Dispute Resolution and Arbitration

11.1 Informal Resolution

Before initiating any formal dispute resolution, you agree to first contact us at hello@birthdayhunter.com to attempt to resolve the dispute informally. We will attempt to resolve disputes within 30 days.

11.2 Binding Arbitration

IF WE CANNOT RESOLVE A DISPUTE INFORMALLY, YOU AND BIRTHDAY HUNTER AGREE THAT ANY DISPUTE, CLAIM, OR CONTROVERSY ARISING FROM OR RELATING TO THESE TERMS OR THE SERVICE SHALL BE RESOLVED BY BINDING INDIVIDUAL ARBITRATION, RATHER THAN IN COURT.

Arbitration shall be conducted by a single arbitrator under the rules of the American Arbitration Association (AAA) in accordance with its Consumer Arbitration Rules. The arbitration shall take place in Wyoming, USA, or another mutually agreed location. The arbitrator's decision shall be final and binding.

11.3 Class Action Waiver

YOU AND BIRTHDAY HUNTER AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS OR REPRESENTATIVE ACTION. Unless both parties agree otherwise, the arbitrator may not consolidate more than one person's claims.

11.4 Exceptions

Notwithstanding the above, either party may bring an individual action in small claims court or seek injunctive relief in any court of competent jurisdiction for infringement of intellectual property rights.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, United States, without regard to its conflict of law provisions. Any legal action not subject to arbitration shall be brought exclusively in the state or federal courts located in Wyoming.

13. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including breach of these Terms. Upon termination:

• Your license to use the Service will immediately cease
• We may delete your account and data (subject to legal retention requirements)
• Provisions that should survive termination will remain in effect (including limitations of liability, indemnification, and dispute resolution)

14. General Provisions

14.1 Entire Agreement

These Terms, together with our Privacy Policy and any additional terms you agree to, constitute the entire agreement between you and Birthday Hunter regarding the Service.

14.2 Severability

If any provision of these Terms is found invalid or unenforceable, that provision shall be enforced to the maximum extent permissible, and the remaining provisions shall remain in full force and effect.

14.3 Waiver

Our failure to enforce any provision of these Terms shall not constitute a waiver of that or any other provision. Any waiver must be in writing and signed by us.

14.4 Assignment

You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign these Terms without restriction.

14.5 Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including acts of God, natural disasters, war, terrorism, pandemic, labor disputes, or governmental actions.
