Terms of Service

Welcome to Birthday Hunter. These Terms of Service ("Terms") are a binding agreement between you ("you" or "User") and Birthday Hunter ("we," "us," "our," or the "Company"). They govern your access to and use of the Birthday Hunter mobile app, website, and related services (together, the "Service").

1. Who Can Use Birthday Hunter

You must be at least 13 years old to create an account. If you are under the age of majority where you live (often 18), you represent that a parent or legal guardian has reviewed these Terms and permits your use. Users aged 13–17 are placed in a restricted mode (see our Privacy Policy). Birthday Hunter is not directed to children under 13, and we do not knowingly allow them to create accounts.

If you are using the Service on behalf of a business or organization, you represent that you have the authority to bind that entity to these Terms.

2. Your Account

2.1 Registration and Accuracy

• Provide accurate, current information when you create your account.
• Keep your information (including your birthday) up to date.
• Do not create more than one personal account, and do not create an account on behalf of someone else without their permission.

2.2 Credential Security

You are responsible for keeping your login credentials confidential and for everything that happens under your account. Tell us immediately at hello@birthdayhunter.com if you suspect unauthorized access.

2.3 Suspension and Termination

We may suspend or terminate your account, with or without notice, for any violation of these Terms, suspected fraud, abuse of the rewards or offerwall programs, or extended inactivity, or where required by law. You may close your account at any time from the app's Settings or by emailing us.

3. How the Service Works

3.1 What We Do

Birthday Hunter helps you discover birthday deals, freebies, and offers from restaurants, retailers, and brands. We also operate a rewards-points program, allow merchants to target audience segments (without exposing your personal information — see our Privacy Policy), and show ads and an offerwall in some parts of the app.

3.2 We Are Not the Merchant

BIRTHDAY HUNTER IS AN AGGREGATOR AND RECOMMENDATION SERVICE. WE DO NOT CREATE, CONTROL, FULFILL, OR GUARANTEE ANY MERCHANT OFFER DISPLAYED IN THE SERVICE.

We make reasonable efforts to keep offer details accurate, but we cannot guarantee the availability, timing, or terms of any offer. Merchants may change, restrict, or discontinue offers at any time.

3.3 If Something Goes Wrong with an Offer

If a merchant refuses to honor an offer, the terms are different from what we showed, or something else is off, please use the in-app “Report this deal” flow. We use those reports to keep the catalog accurate and to flag merchants who repeatedly misrepresent offers. We do not adjudicate disputes between you and merchants, but reliable reports help other users.

4. Bday Bucks Rewards Program

Birthday Hunter includes a rewards program we call “Bday Bucks.” The following rules apply:

• Bday Bucks have redeemable value. You can redeem earned Bday Bucks through the in-app cash-out and rewards options we make available from time to time (for example, gift cards or equivalent cash-out methods). Rewards catalog, redemption thresholds, and processing times are set by us and may change.
• Bday Bucks are not transferable between accounts, cannot be inherited, sold, assigned, or combined across accounts, and have no value outside of the Birthday Hunter Service.
• Bday Bucks can be earned by completing actions we designate (e.g., answering profile questions, referring friends, claiming offers, opening notifications, completing offerwall tasks).
• We may adjust, cap, reverse, or forfeit Bday Bucks at any time if we reasonably believe they were earned through fraud, abuse, bots, multiple accounts, incentive stacking, false information (including fake birthdays), or any violation of these Terms. Pending redemptions tied to the disputed balance may be cancelled.
• We may expire inactive Bday Bucks after 12 months of account inactivity. We will try to warn you by email or in-app notice before expiration.
• We may end the Bday Bucks program or change its rules at any time. If we end the program, we will give reasonable notice and provide a window in which remaining balance can be redeemed.
• Offerwall rewards (OGAds and similar) are credited when the third-party network confirms the qualifying action. We depend on those networks for confirmation; if the network does not credit the action to us, we cannot credit Bday Bucks to you.
• Cash-out redemptions are subject to identity verification where required to prevent fraud. We may delay or refuse a cash-out that fails verification, appears duplicative, or violates these Terms.

5. Acceptable Use

You agree not to:

• Use the Service for any illegal, harmful, or unauthorized purpose.
• Submit false or misleading information, including false birthdays, to earn rewards or access offers.
• Create multiple accounts, use bots, emulators, or automation to claim offers, earn points, or complete offerwall tasks.
• Scrape, harvest, or systematically copy content from the Service (including deal listings).
• Reverse engineer, decompile, disassemble, or attempt to extract the source code of the app.
• Interfere with or disrupt the Service, its servers, or the networks connected to it.
• Attempt to access another user's account or any non-public part of our systems.
• Use the Service to send spam, phishing, or other unsolicited communications.
• Impersonate any person or entity, or misrepresent your affiliation.
• Resell, relicense, sublicense, or commercially exploit any part of the Service or its content.
• Submit content that is unlawful, harassing, defamatory, obscene, infringing, or otherwise objectionable.

Violations may result in removal of content, forfeiture of points, suspension or termination of your account, and referral to law enforcement where appropriate.

6. Subscriptions, Purchases, and Billing

6.1 Free and Premium Tiers

Birthday Hunter is free to use with ads. We also offer a premium subscription (“Birthday Hunter Pro” or similar) with additional features, ad-free experience, and other benefits we may add over time.

6.2 Billing Through the App Stores and RevenueCat

Subscription billing is handled by the Apple App Store (for iOS), Google Play Store (for Android), or our subscription provider RevenueCat. When you subscribe, you authorize the applicable store to charge your payment method on a recurring basis at the listed price until you cancel.

6.3 Automatic Renewal

SUBSCRIPTIONS RENEW AUTOMATICALLY AT THE END OF EACH BILLING PERIOD UNLESS YOU CANCEL BEFORE THE RENEWAL DATE.

• Monthly plans renew every month; annual plans renew every 12 months.
• Prices may change; we will notify you before a price change takes effect on your subscription.

6.4 Cancellation

You can cancel at any time by managing your subscription in your Apple ID or Google Play account. Cancellation takes effect at the end of the current billing period; you keep premium access until then.

6.5 Refunds

We do not process subscription refunds directly. Refund requests for App Store and Google Play purchases are handled by Apple and Google under their respective policies. Where required by law (for example, consumer-protection rules in some U.S. states and in the EU/UK), you may be entitled to specific cancellation or refund rights — those rights apply in addition to these Terms.

6.6 Free Trials

If we offer a free trial, we'll tell you how long it lasts and when your payment method will be charged if you don't cancel. Trial terms are otherwise governed by this Section 6.

7. Intellectual Property

7.1 Our Content

The Service — including the app, the website, our logo, design, text, graphics, software, data compilations, and the “Birthday Hunter” name — is owned by us or our licensors and is protected by copyright, trademark, and other intellectual-property laws.

7.2 Limited License to You

Subject to your compliance with these Terms, we grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Service for your personal, non-commercial use. You may not copy, modify, distribute, sell, or create derivative works from the Service, except as expressly permitted in these Terms.

7.3 Merchant Marks

Names, logos, and marks of merchants shown in the Service are the property of their respective owners. We display them to describe their offers; their display does not imply endorsement, sponsorship, or affiliation unless we explicitly say so.

7.4 Content You Submit

When you submit content to the Service (e.g., deal tips, reviews, reports, feedback), you keep ownership of that content. You grant us a worldwide, non-exclusive, royalty-free, sublicensable license to use, reproduce, modify, publish, translate, and display that content in connection with operating and improving the Service. You represent that you have the rights to grant this license and that your content does not violate the rights of any third party.

8. Third-Party Services

The Service integrates with third-party services including, without limitation, Apple and Google (app stores and push), Supabase (database / auth), Firebase (analytics, crash, performance), Microsoft Clarity (masked session analytics), Google Analytics, RevenueCat (subscription management), and AdMob / OGAds (ads and rewarded offers). Your use of those third-party services is subject to their own terms and privacy policies. We are not responsible for them.

9. Disclaimers

We do not warrant that:

• The Service will be uninterrupted, secure, or error-free.
• Any offer, deal, or reward displayed will be available, valid, or honored by the merchant.
• Information shown (including offer terms, expirations, eligibility, and nutritional or allergen details) is accurate, complete, or current.
• The Service will meet your requirements or expectations, or that defects will be corrected.
• The Service or the servers that provide it are free of viruses or other harmful components.

Some jurisdictions do not allow the exclusion of certain warranties. In those jurisdictions, the exclusions above apply to the fullest extent permitted by law.

10. Limitation of Liability

This applies to any claim arising from or related to:

• Your use of, or inability to use, the Service.
• Any content or information obtained through the Service.
• Unauthorized access to or alteration of your data.
• Conduct or content of any third party on or through the Service, including merchants.
• Any offer or reward displayed or redeemed through the Service.

IN NO EVENT WILL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100 USD).

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for gross negligence, willful misconduct, fraud, or for death or personal injury caused by negligence (where recognized).

11. Indemnification

You agree to indemnify, defend, and hold harmless Birthday Hunter and its officers, directors, employees, agents, affiliates, and licensors from and against any claims, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from or related to:

• Your use of the Service;
• Your violation of these Terms or our Privacy Policy;
• Your violation of any third-party right, including intellectual property, privacy, or publicity rights;
• Your violation of any applicable law or regulation;
• Any content you submit to the Service;
• Your interactions with merchants or other third parties through the Service;
• Any fraudulent, abusive, or deceptive conduct on your part, including rewards-program abuse.

12. Dispute Resolution — Arbitration and Class-Action Waiver

PLEASE READ THIS SECTION CAREFULLY. IT LIMITS HOW YOU CAN SEEK RELIEF FROM BIRTHDAY HUNTER AND REQUIRES MOST DISPUTES TO BE RESOLVED BY INDIVIDUAL ARBITRATION INSTEAD OF IN COURT.

12.1 Informal Resolution First

Before starting any formal proceeding, you agree to first contact us at hello@birthdayhunter.com with a description of the issue and what resolution you are seeking. We will try in good faith to resolve the dispute within 60 days.

12.2 Binding Individual Arbitration

If we cannot resolve a dispute informally, you and Birthday Hunter agree that any dispute, claim, or controversy arising out of or relating to these Terms, the Privacy Policy, or the Service will be resolved by binding individual arbitration, not in court, except as provided below. The arbitration will be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration will be conducted in the county where you live, by telephone, by video, or through document-only proceedings, at your election. The arbitrator's decision is final and enforceable in any court of competent jurisdiction. The Federal Arbitration Act governs the interpretation and enforcement of this Section 12.

12.3 Class-Action Waiver

YOU AND BIRTHDAY HUNTER AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate more than one person's claims and may not preside over any class or representative proceeding.

12.4 Exceptions

Either party may bring an individual action in small claims court for disputes within that court's jurisdiction. Either party may seek injunctive or equitable relief in a court of competent jurisdiction to prevent the infringement or misuse of intellectual property rights. This Section 12 does not preclude you from filing a complaint with any government agency.

12.5 30-Day Opt-Out

You may opt out of the arbitration agreement and class-action waiver in this Section 12 by sending a written notice to hello@birthdayhunter.com with the subject line “Arbitration Opt-Out” within 30 days of first accepting these Terms (or, for users with existing accounts, within 30 days of the effective date of this version). Your notice must include your account email and a clear statement that you are opting out of arbitration. Opting out will not affect any other part of these Terms.

12.6 Severability

If any part of this Section 12 is found unenforceable, the remainder will continue to apply. If the class-action waiver is found unenforceable for a particular claim, that claim will proceed in court and the rest will proceed in arbitration.

13. Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws rules, except to the extent a mandatory consumer-protection law of your state of residence applies. Any action not subject to arbitration (for example, small-claims court actions, or IP injunctive-relief actions) must be brought in the state or federal courts located in New Castle County, Delaware.

14. Termination

You may stop using the Service at any time. We may suspend or terminate your access immediately if we reasonably believe you have violated these Terms, created risk for us or other users, or where required by law. On termination:

• Your license to use the Service ends immediately.
• We will delete your account and data consistent with our Privacy Policy (within 30 days; backups rotate within 90 days).
• Sections that should survive termination do — including 7 (IP), 9 (disclaimers), 10 (liability limits), 11 (indemnification), 12 (dispute resolution), and 15 (general).

15. Changes to These Terms

We may update these Terms from time to time. If we make a material change, we will give you at least 30 days' notice by email (to the address on your account) and by an in-app banner before the change takes effect, unless a shorter period is required by law. Non-material changes (typos, clarifications, addition of new features' terms that do not reduce your rights) take effect when posted. The “Last updated” date at the top of this page always reflects the most recent revision. Continued use of the Service after the effective date constitutes acceptance of the updated Terms. If you do not agree, stop using the Service before the change takes effect and, if you want, close your account.

16. General Provisions

16.1 Entire Agreement

These Terms, together with our Privacy Policy and any terms we reference in them or post in the Service, are the entire agreement between you and Birthday Hunter and supersede any earlier agreements.

16.2 Severability

If any provision of these Terms is found unenforceable, it will be enforced to the maximum extent permissible, and the remaining provisions will stay in effect.

16.3 Waiver

Our failure to enforce a provision is not a waiver. Any waiver must be in writing and signed by us.

16.4 Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, financing, or sale of assets, or to an affiliate.

16.5 Force Majeure

We are not liable for any failure or delay in performance due to events beyond our reasonable control, including acts of God, natural disasters, war, terrorism, pandemic, labor disputes, internet or cloud-provider outages, or government actions.

16.6 Apple App Store Additional Terms

If you downloaded the app from the Apple App Store, the following also applies: these Terms are between you and Birthday Hunter, not Apple; Apple is not responsible for the Service or any claims relating to it; Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

16.7 Google Play Additional Terms

If you downloaded the app from Google Play, your use of the Service is also subject to the Google Play Terms of Service. Google is not a party to these Terms and is not responsible for the Service.

16.8 U.S. Export Controls

You represent that you are not located in a country subject to U.S. Government embargo, not on any U.S. Government restricted-party list, and will not use the Service in violation of export-control laws.
